General Administration of Customs’ Decision on Amending Certain Regulations (Decree No. 263 of the General Administration of Customs)

To implement the spirit of the 20th National Congress of the Communist Party of China, support the high-quality development of bonded warehouses and export supervision warehouses, and improve the requirements for random inspection and testing of imported and exported goods, the General Administration of Customs has decided to modify three regulations: “Regulations on the Management of Bonded Warehouses and Goods Stored Therein by the Customs of the People’s Republic of China,” “Measures for the Management of Export Supervision Warehouses and Goods Stored Therein by the Customs of the People’s Republic of China,” and “Measures for Random Inspection and Testing of Import and Export Commodities.” The specific modifications are as follows:

Modifications to the “Regulations on the Management of Bonded Warehouses and Goods Stored Therein by the Customs of the People’s Republic of China” (Customs Order No. 105, revised according to Customs Orders No. 198, No. 227, No. 235, No. 240):

In Article 5, revise “The following goods can be stored in bonded warehouses with customs approval” to “The following bonded goods and other goods without completed customs procedures can be stored in bonded warehouses.”

Revise item 1 in Article 8 to “(1) Obtain qualifications as an operator.”

Delete “and receive customs training” in Article 15.

Revise Article 17: When there is a change in the name or entity type of a bonded warehouse operating enterprise or a change in warehouse name, etc., within 30 days from the date of such change, the bonded warehouse operating enterprise shall apply for changes with competent customs authorities.

Modify item (a) in Article 23 to: “(a) continue to implement bonded supervision when transported to special customs supervision zones or bonded supervision places within China.” Add a clause as item (b): “For bonded storage goods that have completed customs procedures, the consignor and consignee shall remove them from the bonded warehouse within the time limit specified by the customs.
